Pennsylvania eviction steps

  1. Notice to quit. 10 days for nonpayment of rent; 15 days for leases of one year or less (30 days for longer leases) for other reasons, unless the lease validly waives notice. (68 P.S. §250.501)
  2. File the landlord-tenant complaint. File with the MDJ for the property's location; a constable serves the complaint and the court sets a hearing. (Delaware County MDJ landlord-tenant FAQ)
  3. Hearing and judgment. The MDJ decides the case; costs are recoverable as part of the judgment.
  4. Order for possession. After the appeal period, the landlord can request an order for possession, which a constable serves before the lockout. Ask the MDJ office for current timing.
