Step by step

  1. 10-day notice. For unpaid rent, give at least 10 days' written notice. The tenant can stop the termination by paying in full before the notice runs out. (Ind. Code §32-31-1-6)
  2. File for possession. File in the court that hears small claims for the county; the clerk issues the summons.
  3. Hearing and order. At the hearing, the court can enter an order for possession and set a move-out date.
