Georgia calls an eviction a dispossessory action. The 2024 Safe at Home Act (HB 404) added a required notice to pay or vacate for unpaid rent on leases entered into or renewed on or after July 1, 2024. Fees are set county by county.
Step by step
- Demand / notice. Demand possession. For unpaid rent and other charges, give a written notice to pay or vacate with at least 3 business days to cure (posted in a sealed envelope on the door, plus any delivery method in the lease). (O.C.G.A. §44-7-50 (as amended by HB 404))
- File the dispossessory affidavit. File in magistrate court; the sheriff or marshal serves the tenant. (HB 404 (2024))
- Answer and hearing. The tenant has 7 days after service to answer. If there is no answer the landlord may ask for a default judgment; otherwise the court sets a hearing.
- Writ of possession. After a judgment for possession, the landlord requests a writ of possession, which the sheriff or marshal executes. Ask your county's court about current waiting periods.
