Florida eviction steps

  1. Notice. For unpaid rent, a 3-day notice to pay or vacate (weekends and legal holidays excluded). For other lease violations, a 7-day notice. (Fla. Stat. §83.56)
  2. File in county court. File the complaint for possession with the clerk and have the sheriff (or a certified process server) serve each tenant. (Fla. Stat. §34.041 (filing fees))
  3. Tenant response. The tenant has 5 days (excluding weekends and legal holidays) after service to respond and, if rent is disputed, deposit it into the court registry. (Fla. Stat. ch. 83, Part II)
  4. Judgment and writ. After judgment for possession the clerk issues a writ of possession. The sheriff posts it and puts the landlord in possession after 24 hours. (Fla. Stat. §83.62)
