Arizona eviction steps

  1. 5-day notice. For unpaid rent, a written 5-day notice to pay or the rental agreement terminates. For material noncompliance, a 10-day notice. (A.R.S. §33-1368)
  2. File special detainer. File in justice court. The summons is issued the day the complaint is filed. (A.R.S. §33-1377)
  3. Trial. The tenant must appear not more than 6 nor less than 3 days from the date of the summons. (A.R.S. §33-1377(B))
  4. Writ of restitution. No writ of restitution may issue until 5 calendar days after judgment. (A.R.S. §12-1178(C))
